Details

Spain follows EU agricultural regulations (Regulation EU 2021/2115 and the prior Regulation EU 1307/2013) which permit cultivation of hemp varieties with THC content below 0.2%. CBD products derived from compliant hemp are not explicitly listed as controlled substances in Spain's Ley Orgánica 1/1979 (General Penitentiary Law) drug schedules, but enforcement at borders is inconsistent. Products with THC content above 0.2% are treated as cannabis derivatives under Spain's Narcotics Law (Ley Orgánica 1/1992). Travellers importing CBD oil should carry a certificate of analysis (CoA) confirming THC concentration. Spanish customs (AEAT) may confiscate products if THC cannot be verified.

Practical advice

Carry the manufacturer's CoA and keep the product in its original labelled packaging. Given inconsistent enforcement, consider leaving CBD products at home to avoid delays or confiscation.
