Italy's Legge 242/2016 on industrial hemp permits cultivation of varieties with THC content below 0.2% and extends to derived products. The Istituto Superiore di Sanità (ISS) maintains guidance on permissible CBD product categories. However, Italian courts and law enforcement have applied inconsistent standards: the Supreme Court (Corte di Cassazione, Sezioni Unite 30475/2019) held that hemp products with THC above 0.5% are narcotic substances under the D.P.R. 309/1990 (Testo Unico Stupefacenti). For imports, CBD oil should be accompanied by a certificate of analysis confirming THC ≤0.2%. Products above 0.5% THC are treated as a narcotic.
