Cannabis seeds are classified as a Schedule I controlled substance under the Controlled Substances Act (CSA) at the federal level. U.S. Customs and Border Protection (CBP) enforces federal law regardless of state marijuana laws. Bringing cannabis seeds into the US — even from a jurisdiction where cannabis is legal — is illegal. CBP X-ray and inspection processes frequently identify seeds. Penalties include seizure, civil fines, and in serious cases criminal prosecution. Even hemp seeds (Cannabis sativa with <0.3% THC) require USDA and CBP documentation to import legally.

Surrender at customs

CBP accepts voluntary surrender of cannabis seeds (all varieties — Controlled Substance Act applies regardless of germination viability). Surrender at primary inspection or Red Channel. CBP Form 6051S waived for proactive surrender. No referral to prosecution for personal quantities.

Practical advice

Do not bring cannabis seeds to the US. State legality is irrelevant at federal border crossings.
